New Small Claims Court: How they work

New Small Claims Court:

The Small Claims Court is an establishment under the Small Claims Act 2016. This a subordinate court in the structure of the court system in Kenya under Article 169 (1) of the Constitution with a monetary jurisdiction of matters not exceeding Kshs1 million. The aim of this New Small Claims Court is to settle small claims that do not exceed Kenya shillings one million (KES 1,000,000).

The establishment of the courts is part of an initiative to enhance the ease of doing business in the country. These courts are intended to reduce backlog of cases by having disputes resolution through simple, inexpensive and expeditious procedures, thus enhancing access to justice.

The main objective of the court is to guarantee the right of access to justice as envisioned under Article 48 of the Constitution through simplicity of procedure, timely disposal of proceedings, fairness of process and reasonable court fees.

Here is How the New Small Claims Court work.

Procedure on Filing Matters

The following procedures shall apply to the matters filed under the New Small Claims Court.

  • Download the Small Claims Court Forms from the Judiciary website using the following link: Click here to download small claims court form
  • Fill in all the details as provided for in the form.
  • Filing of All documents shall be electronically in PDF format.
  • All documents filed MUST have the email address and telephone number of the advocate/party drawing the pleadings and respondent’s contacts.

Step 1

The documents shall be sent to the following email address for processing.

Step 2

The registry will receive your documents, assess the court fees payable and advice you on payment.

Step 3

Make the payments by following the procedure in the payment advise sent on email.

  1. GO to M-Pesa Menu
  2. Lipa na Mpesa and select Paybill 553388
  3. Enter Account Number as the payment reference number starting with EY******
  4. Then Enter Amount
  5. Enter Pin and Send
  6. You will receive a Message from Safaricom
  7. And finally you will receive a message from KCB
  8. Forward the Mpesa and KCB confirmation message to sccnairobi2021@gmail.com

Step 4

Send the payment confirmation text as a reply to the same email thread (don’t send as a separate email)

Step 5

The accounts department will verify payments and issue receipts. It shall place all Original receipts in the court file. The court shall print all electronically received documents and file in the physical court file.

Step 6

The court shall print all electronically received documents and file in the physical court file.

Step 7

Extracted orders shall be scanned and sent to the advocates/Litigants via the provided email address.

Other Registry Services: (Date Fixing, Proceedings Etc)

All request for any other service from the court or registry shall be made on email to the registry and any requisite fee payable shall apply.
